Mental health professionals and the legal system: implications for technology and ethical best practices for risk management

Presented by Sean Knuth, Ph.D.

3 CONTINUING EDUCATION CREDITS

BASE is approved by the American Psychological Association to sponsor continuing education for psychologists. BASE maintains responsibility for this program and its content.

Description

This course is intended to provide practicing mental health clinicians with a more robust understanding of how mental health practitioners can ensure jurisdictional compliance when providing telepsychology and to enable them to better assist in the administration of justice in a manner that is ethically defensible while minimizing concerns about their ability to provide high-quality care to current and future clients/patients, particularly as it relates to civil court proceedings. Attendees will learn about inter-jurisdictional licensure issues and how PSYPACT can help resolve them (Web and Orwig, 2015), will be presented with a framework for appropriately responding to subpoenas (Borkosky, 2020), and will be provided with a discussion of the role of testimony from mental health practitioners in court proceedings (Ackerman and Kane, 2018).

Learning Objectives

Based on the content of this workshop, you will be able to…

  • Recognize and resolve jurisdictional issues related to telepsychology

  • Describe a standard framework for proper responses to subpoenas and other legal involvement.

  • Develop alternative ethical approaches to involvement in legal proceedings

  • Recognize the two general categories of testimony mental health providers may be called upon to provide as part of legal proceedings, and be able to tailor their testimony to ensure adherence to ethical standards.

Audience

This program is appropriate for licensed psychologists interested in incorporating telepsychology into their practice, as well as psychologists and other mental health practitioners  who would like to develop expertise in how to respond to requests for legal involvement from their clients or other individuals. Training is at an introductory level.
